NewsFlash! Premium Processing Will Not Be Expanded to Most Categories Until 2024

Yesterday, the U.S. Citizenship and Immigration Services (USCIS) announced that it would be issuing a final rule to make premium processing available to all form I-140 petitions, and most form I-539 and form I-765 categories. Today, the rule was published in the Federal Register, and much of the information is deeply disappointing.

Per the final rule, the USCIS does not expect that premium processing will be made available for most I-539 categories, including H-4 and L-2, until fiscal year 2025, which runs from October 1, 2024, through September 30, 2025. Similarly, no premium processing will be available for any I-765 category, including H-4 EADs, until fiscal year 2025. For fiscal year 2022, which ends on September 30, 2022, the USCIS expects to expand premium processing to I-539 applications being filed for F, J, and M applicants. The USCIS also anticipates making premium processing available to all I-140 categories this fiscal year.
