I have an EAD based on my pending I-485. I was laid off from my company. How long I can stay in the U.S. with no job?

Answer

A person with a pending I-485 is considered to be legally in the United States in a period of authorized stay. Assuming the I-485 has been pending for at least 180 days, it can be supported by a new job offer that meets the AC21 requirements. In practice, as long as there is such a job offer when the USCIS sends an RFE or otherwise looks at the case, it can still be approved. (16.May.2016)
