When will the I-140 EAD rule go into effect?

Answer

The proposed I-140 EAD rule (which is just one provision in a much larger set of rules) is currently with the Office of Management and Budget. We are expecting it to eventually be published, but there is no anticipated timeline. Be aware, however, that if the final rule is anything like the proposed rule, it will only serve to help a very small number of people. See the MurthyDotCom NewsBrief, I-140 EAD Proposal is Limited and Restrictive (08.Jan.16) for more details on the proposal. Also see Murthy Law Firm’s Comments on Proposed Rule for I-140 EAD, and More (04.Mar.2016) for our recommendations to the Department of Homeland Security on steps that should be taken to improve the rule.
