DOL Announces PERM Case Management System Enhancement

Effective April 15, 2017, the U.S. Department of Labor (DOL) will begin allowing stakeholders to submit documents electronically, via the PERM case management system (CMS), for labor certification (LC) cases, “while the application is pending review and up to 30 calendar days after the notice of proposed final agency action is issued on an application.” Employers, along with their agents and attorneys, have long been permitted to use CMS for purposes of submitting a PERM LC application (form ETA 9089) electronically. By adding this new feature, it now will be possible to submit documents using CMS for audit responses, motions, appeals, and supervisory recruitment cases.

Updated User Guide

In conjunction with the rollout of this new feature, the DOL has also released an updated user guide. The guide provides step-by-step instructions for users on how to upload documents to CMS.

Conclusion

By adding this new feature, the DOL expects that it “will eliminate the need for the employer … to submit responsive documents via U.S. mail, eMail, or facsimile, and result in a more expedient review of applications.” As with any new system, applicants should keep documentation of the uploaded documents, should the DOL have any questions about timely submissions or other information.
