USCIS Resumes Premium Processing for Certain Cap-Exempt H1B Petitions

As of Monday, July 24, 2017, the U.S. Citizenship and Immigration Services (USCIS) resumed accepting requests for premium processing for certain cap-exempt H1B petitions. As explained in the USCIS news release:

Premium processing will resume for petitions that may be exempt from the cap if the H1B petitioner is any one of the following.

  • An institution of higher education
  • A nonprofit related to or affiliated with an institution of higher education
  • A nonprofit research or governmental research organization

Premium processing also will resume for petitions that may be exempt if the beneficiary will be employed at a qualifying cap-exempt institution, organization, or entity.

The news release further notes that premium processing again will be made available for other types of H1B petitions “… as workloads permit.”
