My H1B visa was refused by the consulate because they had concerns related to my employer’s right to control my work. My wife is in the U.S. working in H1B status. Can I now apply for an H-4 visa?

Answer

Generally speaking, being denied issuance an H1B visa would not prevent a person from qualifying for an H-4 visa. (13.Nov.2017)
