My H1B change of employer was just denied. My I-94 expired last month. What options do I now have to move to a new employer?

Answer

Unfortunately, the options here normally are limited. Because the I-94 is now expired, one generally would be out of status and begin to accrue unlawful presence from the date of the denial. In this situation, one typically would need to depart the U.S., obtain a new H1B approval and H1B “stamp,” and then reenter the U.S. (04.Dec.2017)
