DHS Publishes Final Rule for H1B Preregistration – FY 2020 Not Affected

The Department of Homeland Security (DHS) posted a final rule reversing the order by which the U.S. Citizenship and Immigration Services (USCIS) selects H1B petitions under the H1B regular cap and the advanced-degree exemption, and it introduces an electronic registration requirement for petitioners seeking to file H1B cap-subject petitions. The rule will be published in the Federal Register on January 31, 2019, and will go into effect April 1st, though the electronic registration requirement will be suspended for the fiscal year (FY) 2020 cap season.
