Reminder: H1B Cap Cases that were Filed for Change of Status Can Now be Upgraded to Premium

Effective today, May 20, 2019, any cap-subject H1B petition filed for regular processing that requested a change of status may now be “upgraded” to premium processing by filing form I-907. This, of course, only applies if the petition was selected in the H1B lottery.

For all H1B cap cases that did not request a change of status (e.g., consular processing), premium processing is still not available. The U.S. Citizenship and Immigration Services (USCIS) has not yet announced when premium processing will be made available for these cases, other than to state that it will not happen before June 2019.

Premium processing remains available for all H1B petitions not subject to the cap.
