There was a misunderstanding at a store, and I was falsely arrested for shoplifting. All charges against me were eventually dropped. Do I need to disclose this on my DS-160?

Answer

The DS-160 asks, “Have you ever been arrested or convicted for any offense or crime, even though subject of a pardon, amnesty, or other similar action?” If you were arrested for an offense, you generally would have to respond YES to this question. Even if you went to trial and were proven innocent, it does not change the fact that an arrest occurred.

Marking YES in this situation, and then explaining the circumstances (and carrying documents to evidence this at the interview) should not prevent your visa from being issued. Failing to disclose this information, on the other hand, may constitute fraud and could make you permanently inadmissible to the United States. (02.Oct.2019)
