NewsFlash! DHS Proposes Rule to Replace H1B Lottery With Wage-Based Selection Process

This evening, the U.S. Department of Homeland Security (DHS) announced a proposed rule that, if finalized, would end the random selection process used in the current H1B lottery system, and replace it with one that prioritizes H1B registrations based on wage-levels. If this rule is enacted, the U.S. Citizenship and Immigration Services (USCIS) would “rank and select the registrations received generally on the basis of the highest occupational employment statistics (OES) wage level that the proffered wage would equal or exceed for the relevant SOC code and in the area of intended employment…”  MurthyDotCom will post a more detailed analysis of this proposal in the near future.
