Are H1B workers eligible for the $600 stimulus checks?

Answer

It seems likely that many, if not most, H1B workers will be eligible for the stimulus rebates, just as they were eligible for stimulus checks issued earlier this year.

As with the previous stimulus package, “nonresident aliens” are not eligible for the $600 stimulus checks currently being issued. The term “nonresident alien” is defined by tax law, not immigration law. As explained in the MurthyDotCom NewsFlash, Government Report Confirms Many Nonimmigrants Eligible for Stimulus Payment (08.Apr.2020), most H1B workers are not classified as nonresident aliens under tax law.

That being said, we will have to wait for final guidance from the Internal Revenue Service (IRS) to see how the law will be interpreted. (30.Dec.2020)
