NewsFlash! Lawsuit Filed Challenging $100k Fee on H1B
06 Oct 2025A diverse group of organizations has filed suit against Trump’s proclamation that imposes a $100,000 fee on “new” H1B petitions. The organizations, which include schools, religious organizations, labor unions, and workers, presents multiple legal theories as to why the fee is not lawful.
In the lawsuit, the parties argue that only Congress has the authority to impose this type of fee. They also assert that suddenly imposing this $100,000 fee violates the Administrative Procedures Act (APA) for several reasons, including that the President failed to go through the formal regulatory process and that the fee is arbitrary and capricious.
