What does a prudential visa revocation under INA §221(i) mean, and does it affect my nonimmigrant status?
21 Jan 2026Answer
A prudential revocation under INA §221(i) is a discretionary action by the U.S. Department of State that cancels the visa stamp, often based on updated security or database information, such as existence of any criminal record. This typically does not end lawful nonimmigrant status for individuals already in the United States, as long as they continue to meet the requirements of that status. However, the revoked visa cannot be used for future travel or reentry.
Court review of prudential revocations is almost entirely barred by statute. Anyone receiving such a notice should consult with an immigration attorney before making travel plans, as a new visa application may be required. (21.Jan.2026)
