Do I need to include my old I-94 when filing my I-485? Is the current one sufficient?

Answer

When filing an I-485, it is important to be able to show that one has maintained status since last entering the U.S. People often include more of their immigration history than that, but the legal requirement is from the last entry. In employment-based I-485 cases, the USCIS will overlook 180 days of status violations. If the I-485 is filed without the necessary I-94 proof, the USCIS will likely send an RFE later. (21.Sep.2015)
