Transfer Notices for I-485 Applicants No Cause for Alarm

As previously announced, the U.S. Citizenship and Immigration Services (USCIS) is scheduling an in-person interview for any I-485 applicant who filed the I-485 adjustment-of-status application on or after March 6, 2017 based on an I-140. Many of these pending adjustment applications are being transferred to the USCIS National Benefits Center before the interviews are scheduled. As a result, these adjustment applicants are receiving I-797C transfer notices.

If an I-485 applicant receives a transfer notice, this typically is not a cause for concern. It is part of the process of the new interview policy and not an indication of problems with the pending I-485 application.

Conclusion

It is unclear at this time just how long the wait times will be with personal interviews scheduled for all employment-based adjustment applicants, and how this will affect the overall processing time. In the meantime, adjustment applicants should be on the lookout for any communication from the government.
