My priority date finally will be current in July, so I will be filing my I-485 on July 1st. I am scheduled, however, to travel to India on July 20th. Is that going to create any problems?

Answer

One needs to be physically present in the U.S. to file an I-485. After the I-485 is filed, it generally is permissible to travel and return if one is in H or L status and has a valid visa “stamp.” Otherwise, one should await the advance parole document before leaving the U.S. to avoid the risk of abandoning the I-485 application or being trapped abroad.
