My H1B extension was filed a few months ago, and my I-94 expired last week. Today, I learned that the USCIS denied the H1B extension. What should I do?

Answer

One in this situation is likely out of status, and began to accrue unlawful presence as of the date of the denial. It generally is important, therefore, to depart the U.S. as soon as possible. An H1B could be filed for consular processing to permit one to return to the U.S. upon approval. It may be a good idea to consult a qualified attorney. (29.Oct.2018)
