If I want to apply for a green card through the EB5 program, when do I have to make my investment?

Answer

Generally speaking, we recommend making the full investment prior to filing the initial I-526 petition. The regulations technically allow for a person to be “actively in the process of investing” at the time the petition is filed. However, doing so can be risky, and we generally advice our clients to avoid relying on this provision in most circumstances. (01.Jul.2021)
