November 2021 Visa Bulletin Check-In

The U.S. Department of State (DOS) recently held its monthly YouTube program with Charlie Oppenheim, Chief of the Visa Control and Reporting Division. During the program, Mr. Oppenheim provided some updated predictions, and revealed that he soon will be retiring. So, this likely will be the last visa bulletin update provided by him.

EB1 Category

Mr. Oppenheim expects the EB1 category to remain current for all countries of chargeability.

EB2 Category

The cutoff dates in the EB2 category for China and India are expected to slowly advance throughout the year. If demand becomes excessive, such as from EB3-to-EB2 “upgrade” filings, the result could be a halt in forward movement for these cutoff dates – and possibly even retrogression.

The EB2 category is expected to remain current for all other countries of chargeability.

EB3 Category for India and China

Mr. Oppenheim believes there will be little-to-no movement of the cutoff dates in the EB3 category for India and China. He noted that the dates listed on the dates for filing chart (i.e., Chart B) are his best estimates of how far a particular category may move within the next nine months. Given that the cutoff date for EB3 India on the final action chart (i.e., Chart A) is only a week behind its counterpart on Chart B, this illustrates how little Mr. Oppenheim expects EB3 India to advance for months to come.
