My H1B petition and visa stamp are valid through 2026, but my Indian passport expires in 3 months. Can I use these to enter the U.S.?

Answer

It typically is possible to request admission in H1B status, as long as one’s passport, H1B petition, and visa are valid at the time of admission. With an Indian passport, the fact that it expires in 3 months will not prevent the U.S. Customs and Border Protection (CBP) officer at the U.S. port of entry from admitting you; but they likely will truncate your I-94 expiration date to the expiration date of your passport.
