NewsFlash! USCIS Re-Implements Public Charge Rule for All I-485 Applications Filed Since Feb. 24, 2020

The U.S. Citizenship and Immigration Services (USCIS) announced today that, in light of the recent decision by a federal appeals court to lift the injunction on enforcement of the October 2, 2019 public charge rule, this public charge rule will be applied to all applications and petitions postmarked or submitted electronically on or after February 24, 2020. For any I-485 filed between February 24, 2020 and October 13, 2020 without a declaration of self-sufficiency (form I-944) and/or corresponding evidence, the USCIS may issue a request for evidence (RFE). For any I-485 application filed after October 13, 2020, the USCIS will reject the application if it does not include all the proper documents, including a form I-944.
