NewsFlash! Rule That Hikes Prevailing Wages to Be Republished on Thursday

The U.S. Department of Labor (DOL) announced today that, on Thursday, January 14, 2021, it will be republishing the rule that dramatically increases the salary requirements for H1B and PERM labor cases. It will be published as a final rule, and, barring intervention by a federal court or the incoming Biden Administration, would begin to phase in higher wage levels, starting on July 1, 2021.

The DOL initially published this regulation as an interim final rule (IFR), which was in effect from October 8, 2020 until it was blocked by a federal court on December 1, 2020. The final rule that will be published on Thursday is similar, but not identical to the IFR. A more detailed overview of the final rule will be posted on MurthyDotCom in the near future.
