I am a U.S. citizen and wish to sponsor my brother for a green card. If he comes to the U.S. in H1B, will that speed up the process?

Answer

Being in the U.S. in H1B would not normally impact the wait time or processing time. If the beneficiary is in the U.S. in H1B status when the priority date becomes current, it typically would be possible to apply for adjustment of status rather than applying at the consulate for the immigrant visa. But, there are tremendous backlogs in the family-based, fourth preference (FB4) category, which is for siblings of a U.S. citizen. So, the wait time for the priority date to become current will very probably be many, many years. (17.Sep.2020)
