NewsFlash! Trump Administration to Expand Definition of “Public Charge”

The Trump Administration announced over the weekend that it aims to substantially expand the number of foreign nationals who may be inadmissible to the United States for risk of becoming a “public charge” (i.e. a person who is likely to become financially dependent on public benefits). The U.S. Department of Homeland Security (DHS) intends to issue the proposed regulation in the coming weeks. While complete details are not yet available, the DHS press release indicates that the rule would broaden the categories of public benefits looked at to determine whether a foreign national may be deemed a public charge.
