USCIS Launches New Online PDF Filing Process
10 Oct 2024The U.S. Citizenship and Immigration Service (USCIS) launched a new online filing process 08.Oct.2024, where an individual can file certain forms online by uploading a completed PDF application rather than completing an online form or physically mailing documents to the USCIS. Although the initial rollout of this new process is limited, it demonstrates how the process works and provides insight into how it could be expanded in the future.
PDF Filing Option Initially Limited
The initial rollout of the new online PDF filing process is very limited in scope. The only forms that are available are the form I-765, application for employment authorization, and form I-912, request for fee waiver. Furthermore, the process initially is open only to applicants in certain adjustment of status categories wishing to file form I-765, including a family- or employment-based immigrant, special immigrant juvenile, T or U nonimmigrant, special immigrant Iraqi or Afghan national, an abused or battered spouse or child, or refugee.
Importantly, although an individual who has filed a form I-485, application for adjustment of status, before 01.Apr.2024 generally may be exempt from paying an I-765 filing fee, a fee will be required when using the new PDF filing process unless an individual is otherwise eligible for a fee waiver.
How the New Online PDF Filing Process Works
The new online filing process uses the familiar paper format rather than an online application. An individual must first download the PDF version of the applicable form from the USCIS website, properly complete the application by typing the information in the applicable form fields, and then file the completed form with the USCIS by uploading it through the individual’s myUSCIS account. The applicant also can print the form and complete it by hand, but the USCIS recommends completing the form on a computer. The individual will sign the form electronically and pay any applicable USCIS filing fees online or request a fee waiver using form I-912, which can also be filed using the new PDF filing option. After submission, the USCIS will either accept or reject the filing within 30 days. Currently, the new filing process is available only to individual applicants who are not represented by an attorney.
Conclusion
The new online PDF filing process is a positive step towards modernizing and easing the U.S. immigration process. While the availability and usage of the new process is limited in its initial release, the USCIS has plans to make the process accessible to attorneys or accredited representatives and available for other immigration forms.
