USCIS Increasing Premium Processing Fees

The U.S. Citizenship and Immigration Services (USCIS) recently published a final rule in the Federal Register announcing an increase in premium processing fees that will go into effect February 26, 2024. The fee increase is based on the inflation index from June 2021 through June 2023.

Summary of Increase in Premium Processing Fees

  • Form I-129, Petition for H2B or R-1 Nonimmigrant
    • Current Premium Processing Fee: $1,500
    • New Premium Processing Fee: $1,685
  • Form I-129, Petition for Nonimmigrant (other than for H2B or R-1)
    • Current Premium Processing Fee: $2,500
    • New Premium Processing Fee: $2,805
  • Form I-539, Applications to Extend / Change Nonimmigrant Status (for eligible categories)
    • Current Premium Processing Fee: $1,750
    • New Premium Processing Fee: $1,965
  • Form I-140, Immigrant Petition
    • Current Premium Processing Fee: $2,500
    • New Premium Processing Fee: $2,805
  • Form I-765, Applications for Employment Authorization (for eligible categories)
    • Current Premium Processing Fee: $1,500
    • New Premium Processing Fee: $1,685

Conclusion

The revised fees will be effective for premium processing requests with a postmark date on or after February 26, 2024. The USCIS is authorized by Congress to review and increase its premium processing fees every two years to keep pace with inflation.
