My employer filed an H1B amendment for me a few months ago that is still pending. Can a second amendment be filed for me now, or do we need to wait for the first one to be approved?

I just learned that my previous employer is being investigated for taking kickbacks related to the company’s immigration filings. I have an approved I-140 from that company, but I was not involved in any type of kickback scheme. Will this impact my ability to use the priority date from that I-140 for the EB2 case being filed by my new employer?
